Lawyers in Lucknow

Lucknow has a permanent bench of the Allahabad High Court in Gomti Nagar, a large civil court campus in the old city, revenue courts for farmland under the UP Revenue Code, and a host of state tribunals because the government sits here. Nazul and leasehold land, LDA approvals, waqf property and the 2021 tenancy law shape most property questions. This guide explains the courts, land and rent rules, family and police matters, legal aid and fees in plain words. When you are ready, describe your matter in the form and an enrolment-verified advocate in Lucknow who handles it can call you. It is free for clients.

Lawyers in Lucknow: the short version

  • Lucknow hosts a bench of the Allahabad High Court. The principal seat is at Prayagraj, but the Lucknow Bench, a successor to the old Chief Court of Oudh, takes writs, appeals and bail matters from the Awadh districts and sits in its own building in Gomti Nagar.
  • The civil court sits by the Gomti in the old city. District and sessions judges, civil judges, magistrates and a string of special courts work from one large campus, with family, commercial and accident claims courts alongside.
  • Farmland questions go to revenue courts. Under the Uttar Pradesh Revenue Code, 2006, division of a holding, declaration of bhumidhari rights and mutation are decided by the tehsildar, the SDM and the collector, with the Board of Revenue above them.
  • Tenancies now run under a 2021 law. The Uttar Pradesh Regulation of Urban Premises Tenancy Act requires a written agreement, a report to the Rent Authority and caps on yearly increases.
  • Nazul and leasehold land is a Lucknow peculiarity. Many plots in central and old Lucknow stand on government-owned nazul land held on lease, which changes what a buyer actually gets.
  • Advocates here enrol with the Bar Council of Uttar Pradesh, headquartered at Prayagraj.
  • Free for clients. Write a few lines about your problem in the box on this page. Checked Lucknow advocates who take that type of work can read it without seeing your phone number, and whoever accepts it rings you.

How Lucknow's legal system fits together

Lucknow is both the seat of the Uttar Pradesh government and the old capital of Awadh, and its courts carry both histories. Before independence, the province of Oudh had its own Chief Court in Lucknow. When the courts of the United Provinces were merged in 1948, that court became the Lucknow Bench of the High Court at Allahabad, and it has sat permanently ever since. Because the state secretariat, the police headquarters and most directorates are in Lucknow, a very large number of writ petitions against the state are filed at this bench, along with service disputes of government employees, criminal appeals and bail applications from the surrounding districts. In 2012 the bench moved from its old premises to a large new building in Gomti Nagar.

Below the bench, the Lucknow judgeship works from the civil court campus in the old city near Qaisarbagh. Here the district judge supervises additional district and sessions judges, civil judges of senior and junior division, the chief judicial magistrate and other magistrates, and special courts for offences against children, atrocity cases, corruption, narcotics and cases against legislators. Family courts, the commercial court and motor accident claims tribunals deal with their own streams of work. The rural tehsils of Malihabad and Mohanlalganj have civil judges of their own as well.

A third layer is easy to miss: the revenue courts. Uttar Pradesh consolidated its land laws into the Revenue Code in 2006, brought into force in 2016, and many disputes over agricultural land on the city's edges begin before the tehsildar or the SDM rather than in a civil court. With the city spreading into villages along the Kanpur, Sultanpur, Sitapur, Raebareli and Faizabad roads, revenue law, land use change and Lucknow Development Authority approvals decide a great deal of property litigation. The sections below walk through each forum, the state laws that matter most, and how to pick someone who actually appears in the right forum.

High Court, Lucknow Bench

Writs against the state, criminal and civil appeals, bail and service cases from the Awadh districts.

Civil court campus

District and sessions courts, civil judges, magistrates, special courts and the commercial court by the Gomti.

Revenue courts

Tehsildar, SDM, collector and commissioner for farmland, with the Board of Revenue at the top.

Tribunals

Services tribunal, CAT, DRT, ITAT, Armed Forces Tribunal, Waqf Tribunal and the state consumer commission.

Land and planning

LDA, Awas Vikas Parishad, the Nagar Nigam, sub-registrar offices and UP RERA.

Police

Lucknow Police Commissionerate since 2020, with zones headed by deputy commissioners.

Choosing a Lucknow lawyer in six steps

  1. Write down the place. Note the thana, the mohalla or village and the tehsil. The thana decides which magistrate takes a criminal case; the tehsil decides which revenue court hears a land dispute.
  2. Sort revenue from civil. If the land is still recorded as agricultural in the khatauni, a share or title dispute usually belongs to the revenue courts. Flats, built houses, shops and money claims go to the civil court.
  3. Look for a dedicated forum. Tenancy disputes go to the Rent Authority, builder delays to UP RERA or the consumer commission, government job disputes to the State Public Services Tribunal, and waqf property to the Waqf Tribunal.
  4. Match the lawyer to the forum. Someone who spends the week at the Gomti Nagar bench may rarely appear before an SDM, and the reverse is just as true. Ask where most of their hearings happen.
  5. Confirm the enrolment. Write down the number on the Bar Council of Uttar Pradesh card and check it against the council's records.
  6. Agree the terms in writing. Settle what work is included, how the fee is split across stages and who attends routine dates.

Our national how-to-hire guide covers fee patterns and warning signs, and the call back page explains what happens once you post.

Outlying civil courtsCivil judges for the Mohanlalganj and Malihabad areas

Pecuniary limits and the allocation of police stations to particular magistrates are fixed by notification and revised from time to time. Before you file, ask your advocate to confirm the court that currently takes your type of case from your area.

Revenue courts under the UP Revenue Code

The Uttar Pradesh Revenue Code, 2006 replaced the old zamindari abolition law and a long list of revenue statutes. For agricultural land, it gives revenue courts exclusive power over a range of suits, and a civil court will return such a case if it is filed there.

Older Lucknow records are often written in Urdu or contain Persian revenue terms. When a title goes back several decades, a lawyer who can read these entries, or who works with someone who can, saves a lot of guesswork.

Buying property in Lucknow: titles, nazul and approvals

Freehold, leasehold and nazul land

Not every Lucknow property is owned outright. A good deal of land in the older parts of the city is nazul, meaning land that vests in the state and was historically leased to individuals, institutions and businesses. Plots allotted by the Lucknow Development Authority or the Awas Vikas Parishad may also be leasehold at first, with a freehold deed issued only after all instalments are paid. A buyer who assumes a leasehold plot is freehold can end up holding something that cannot be mortgaged, transferred or rebuilt without the authority's consent. State policy on converting nazul leases to freehold has changed more than once, so ask a lawyer to check the current rules and the plot's file before you pay.

Agricultural land on the city's edge

Much of the new housing along Sultanpur Road, Kanpur Road, Raebareli Road and the outer ring road has come up on land that was farmland a few years ago. If the khatauni still shows agricultural use, the land may need a declaration of non-agricultural use under the Revenue Code before construction, and any colony on it needs an approved layout from the LDA. Plots sold by colonisers without layout approval or road access are a frequent source of later litigation.

A sensible rule in Lucknow is to treat the seller's paperwork as a starting point, not as proof. Pull the khatauni yourself, ask the LDA or Awas Vikas for the allotment file, and compare the boundaries on the deed with what you see on site. Where these do not match, find out why before signing anything, because fixing a defect after registration is far harder than walking away before it.

What to check before buying

Stamp duty and registration

Stamp duty on a sale deed in Uttar Pradesh is 7%, and registration fee is 1%. Women buyers receive a reduction of one percentage point, a benefit that the state extended in 2025 to properties up to ₹1 crore in value. Duty is charged on the higher of the deed price and the circle rate notified by the district magistrate. Gift deeds between close family members now carry a fixed, low duty. Documents are prepared and appointments booked on the IGRSUP portal before the visit to the sub-registrar. Our property lawyer in Lucknow guide goes into more detail.

Renting in Lucknow under the 2021 tenancy law

In 2021 Uttar Pradesh replaced its 1972 rent control law with the Uttar Pradesh Regulation of Urban Premises Tenancy Act. The new law applies to both residential and commercial lettings in urban areas and moves most disputes away from civil courts.

A standard rent agreement can be adapted to the Act's requirements.

The old city, monuments and heritage limits

Lucknow's Nawabi core, from the Bara and Chhota Imambara to Rumi Darwaza, Chowk and the lanes of Aminabad, mixes protected monuments with densely packed homes and shops. That mix brings legal limits that newer colonies do not face.

LDA approvals, sealing and compounding

The Lucknow Development Authority, set up under the Uttar Pradesh Urban Planning and Development Act, 1973, prepares the master plan, approves layouts and building maps, and acts against unauthorised construction across most of the urban area. Its schemes, from Gomti Nagar and Aliganj to newer townships along the outer ring road, account for a large share of the city's formal housing.

The Awas Vikas Parishad, the state housing board, runs its own colonies such as parts of Indira Nagar and Vrindavan Yojana, with separate allotment rules, transfer charges and freehold procedures.

Registering a sale deed in Lucknow

  1. Value the property. Look up the circle rate for the locality on IGRSUP and compare it with the agreed price; duty is paid on the higher figure.
  2. Pay stamp duty. Buy e-stamps through an authorised centre or online, applying the women's concession where the buyer qualifies.
  3. Prepare the deed. Draft the sale deed with property details, boundaries, payment terms and the seller's title history, and upload the data on the portal.
  4. Book a slot. Choose the sub-registrar office with jurisdiction over the property and pay the registration fee.
  5. Appear in person. Seller, buyer and two witnesses attend with identity proof; photographs and biometrics are taken before registration.
  6. Follow through. Apply for mutation in the tehsil, LDA, Awas Vikas or Nagar Nigam records, and transfer electricity and water connections.

Apartments, societies and maintenance disputes

High-rise housing has spread fast along Shaheed Path, Sultanpur Road and in Gomti Nagar Extension. Uttar Pradesh has its own apartment law, the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010, which governs how flat owners form an association, take over common areas and run maintenance.

Waqf property and religious endowments

Lucknow is the headquarters of both the Uttar Pradesh Sunni Central Waqf Board and the Shia Central Waqf Board, and the city has a great deal of property dedicated to imambaras, mosques, karbalas, dargahs and charities. People who live in, rent or manage such property run into rules that differ from ordinary property law.

Village common land and the expanding city

As Lucknow absorbs surrounding villages, buyers and builders keep running into land that should never have been sold privately. The Revenue Code protects land vested in the gram panchayat, and both the state and the courts have taken a firm line on encroachments.

Ring roads, expressways and acquisition

The outer ring road, expressway links, metro corridors and new townships have required land on all sides of Lucknow. Farmers and plot holders in the path of these projects receive notices from the LDA, the highways authority or industrial development bodies.

Business, consumer and workplace disputes

Trade and contracts

Lucknow's traders in chikan embroidery, food, pharma distribution, construction and government supplies often fight over unpaid bills and broken contracts. A legal notice tends to open the matter. Larger commercial claims go to the commercial court after mediation, and micro and small units can approach the MSME facilitation council for delayed payments by buyers.

Consumer claims

District consumer commissions in Lucknow take claims up to ₹50 lakh, the state commission, which also sits in Lucknow, takes claims up to ₹2 crore, and the National Commission handles anything above that. Complaints can be filed online on e-Jagriti. See the consumer lawyer in Lucknow guide.

Jobs and service

Since 21 November 2025, the four national labour codes have taken the place of the older patchwork of labour statutes. In Lucknow, the biggest single group of employment cases involves government servants: transfers, promotions, suspensions and pensions, which go to the State Public Services Tribunal or, for central staff, the CAT. Private sector workers in the Chinhat, Amausi and Sarojini Nagar industrial areas take wage and termination disputes to the labour authorities and courts. Workplace sexual harassment complaints go to the internal committee or the district's local committee. See the labour lawyer in Lucknow guide.

Hospitals and medical negligence claims

Lucknow is a medical centre for much of central and eastern Uttar Pradesh, with large government institutes such as King George's Medical University and the Sanjay Gandhi Postgraduate Institute, and a growing number of private hospitals. Patients travel from far away, and when treatment goes wrong, families often look for legal help in the city.

Chikankari, crafts and small traders

Lucknow's chikan embroidery, which carries a geographical indication, supports thousands of home-based workers, mostly women, along with traders and exporters in Chowk and Aminabad. Zardozi work and the city's food and perfume trades add to a large small-business economy.

Government contracts, tenders and supplies

With so many state departments based in Lucknow, a lot of business revolves around government tenders, supplies and works contracts. Disputes here have their own pattern.

Industry, start-ups and the defence corridor

Lucknow is a node of the Uttar Pradesh Defence Industrial Corridor, and new industrial and IT projects have come up around the city alongside older estates at Chinhat, Amausi and Talkatora. Start-ups in technology, education and food delivery have also grown.

Road accidents and traffic matters

Highways out of Lucknow towards Kanpur, Ayodhya, Sitapur and Agra carry heavy traffic, and accident claims are a steady part of the work at the claims tribunals. Families of injured or deceased victims can claim compensation from the vehicle owner and insurer, with an interim no-fault amount available. The FIR, medical records, income proof and the vehicle's insurance details are the key documents. For traffic challans, many minor cases are settled online or at Lok Adalats, while challenges to wrongful challans go to the court named on the notice.

Lucknow's tehsils and where your matter is heard

Lucknow district is divided into five tehsils: Sadar, Sarojini Nagar, Bakshi Ka Talab, Malihabad and Mohanlalganj. The tehsil matters most for revenue work, because the tehsildar and SDM of that tehsil take mutation, division and boundary cases for land within it. For criminal matters, the thana is what counts, since each police station is attached to particular magistrates. Civil suits are filed where the property lies or where the defendant lives or works.

TehsilAreas it broadly coversTypical disputes
SadarThe core city and older urban wardsNazul leases, old tenancies, joint family houses
Sarojini NagarThe south-west, towards the airport and Kanpur RoadColony plots, industrial land, acquisition for roads
Bakshi Ka TalabThe north, along the Sitapur RoadFarmland division, new townships, cantonment fringe
MalihabadThe north-west mango beltOrchard land, inheritance among large families
MohanlalganjThe south-east, towards Raebareli RoadRapid urbanisation, coloniser plots, boundary fights

Tehsil boundaries and the jurisdiction of particular courts can be changed by government order, so treat this table as a rough guide and confirm with the tehsil or your advocate.

The Gomti, the Kukrail and floodplain land

The Gomti cuts Lucknow in two, and its floodplain and tributaries such as the Kukrail drain have long been built over. In recent years the state has cleared settlements along the Kukrail, including the demolition of Akbar Nagar in 2024 for a riverfront project, with residents offered flats under a housing scheme. Owners on or near riverbeds and drains face real risk.

How a suit to divide farmland usually moves

  1. Get the records. Obtain the latest khatauni and khasra and a family tree, and check that every co-sharer's name and share is correctly entered.
  2. Correct the entries first. If an heir's name is missing, apply for varasat or correction in the tehsil before filing for division.
  3. File the suit. The plaint goes before the SDM of the tehsil, with all co-sharers made parties.
  4. Notice and reply. Co-sharers are served and file their written statements; objections about shares are framed as issues.
  5. Preliminary decree. The court declares each co-sharer's share.
  6. Division on the ground. Revenue officers propose how the plots should be split, taking into account wells, trees and road access. Parties can object.
  7. Final decree and entry. Once confirmed, the khatauni is updated and each co-sharer gets a separate holding.

Contested cases can take years, especially with appeals. Many families save time by agreeing a division and having it recorded, with the court's help, at an early stage.

Court holidays and vacations

The Allahabad High Court, including the Lucknow Bench, closes for a summer vacation in June and a short winter break, with vacation benches sitting for urgent bail, injunction and habeas corpus matters. District courts follow the state's holiday list, which includes festivals such as Holi, Eid, Muharram and Diwali. If a limitation period is about to expire, file before the court closes rather than counting on a vacation bench.

Further questions from Lucknow residents

Can an LDA plot be sold before the freehold deed?

Usually only with the authority's permission and on payment of transfer charges. Check the allotment conditions first.

What happens if I build without a sanctioned map?

The authority can issue notices for sealing or demolition. Some deviations can be compounded on payment under the bye-laws; others cannot.

Can a gram sabha take back land I bought?

If the land was actually village common land, such as a pond or pasture, a private sale does not give good title and the land can be reclaimed.

Is the old 1972 rent law still relevant?

It has been replaced, but pending cases and old tenancies raise transitional questions that need advice.

Where is the Bar Council of Uttar Pradesh?

At Prayagraj.

Everyday legal questions in Lucknow

Day to day, Lucknow residents bring advocates a predictable mix of problems: neighbours building onto a shared wall, house tax assessments from the Nagar Nigam that look too high, electricity bills disputed with the distribution company, cheques from business partners that bounce, tenants who stop paying, and road accident claims on the busy highways leading out of the city. Many of these can be settled with a careful letter, a complaint to the right office or a Lok Adalat, without a full lawsuit. The important thing is to act early, keep copies of everything and get advice before signing any settlement.

What Lucknow lawyers charge

Fees depend on the court, the work involved and the advocate's experience. In the civil court, some lawyers charge per appearance and others a fixed fee for a stage such as drafting and filing. Revenue suits can run through many short dates before the SDM, which adds to the cost over time. Matters at the High Court bench are generally more expensive, especially when a senior counsel argues. Court fee payable under the state's court fees law is a separate cost from the lawyer's fee.

Read our legal fees guide. Clients pay nothing to use Mara Vakil, and advocates do not pay us a commission on fees.

Legal help for particular groups in Lucknow

Government employees and pensioners

As the state capital, Lucknow is home to tens of thousands of serving and retired government staff. Their disputes over seniority, promotion, disciplinary action, pay revision and pension are a large part of the work at the services tribunal and the Lucknow Bench. Keeping copies of every order, representation and service book entry makes these cases far easier to argue.

Widows and daughters in farming families

In villages around Malihabad, Bakshi Ka Talab and Mohanlalganj, women are sometimes left out when the khatauni is updated after a death. The Revenue Code gives widows and daughters a place among heirs, and an application for correct varasat, backed by a family register extract, can put their names on record.

Students

Students at Lucknow's universities, medical colleges and coaching centres meet refund disputes, hostel problems and exam-related grievances. Written receipts and the institution's published rules are the basis of any complaint.

Older people

Elderly parents left without support may ask their children or likely heirs for a monthly allowance before the maintenance tribunal, headed by the SDM, under the 2007 senior citizens law, and can seek to undo a property transfer made in return for care that was never given.

Wills and inheritance in Lucknow

Probate is not required for wills made in Lucknow, and a will is valid if it is signed and attested by two witnesses, whether or not it is registered. Registration at the sub-registrar's office makes forgery claims harder to sustain. After a death, heirs apply for varasat in the tehsil for farmland, and for mutation in the LDA, Awas Vikas or Nagar Nigam records for urban property. For money in banks and shares in companies, the civil court's succession certificate is often what the institution insists on.

For Muslim families, inheritance follows Muslim personal law, with differences between Sunni and Shia rules on shares, and a Muslim's will can cover no more than a third of what they leave unless the heirs agree to more. Hindu, Sikh, Jain and Buddhist families follow the Hindu Succession Act, under which daughters inherit equally with sons. Agricultural land is different: succession to a bhumidhar's holding follows the order of heirs set out in the Revenue Code itself, which is why varasat entries for farmland sometimes surprise families. See the will lawyer in Lucknow guide.

How Lucknow advocates approach common situations

The examples below are made up, but they reflect patterns that come up often.

"The LDA has pasted a sealing notice on our building."

A family in Indira Nagar added two floors without a sanctioned map. Their advocate replies to the notice, examines whether the extra construction can be compounded under the current bye-laws and, if an adverse order follows, files an appeal within time.

"My cousins will not let me farm my share."

A man from Bakshi Ka Talab is a co-bhumidhar of family land. His lawyer files a suit for division of the holding before the SDM and asks for an order restraining any sale while the case runs.

"I was suspended after twenty years of service."

A state employee receives a suspension order and a chargesheet. Her advocate drafts a reply to the charges, keeps a record of the inquiry and, when the punishment is imposed, approaches the services tribunal.

"Our builder in Sushant Golf City is three years late."

A couple waiting for a flat compares remedies before UP RERA and the consumer commission and, with their lawyer, chooses the forum that best fits their demand for interest or a refund.

"The tenant in our Aminabad shop says the old law protects him."

An owner wants to raise the rent of a decades-old tenancy. Her advocate studies how the 2021 Act treats existing tenancies and files before the Rent Authority.

Misconceptions that cost Lucknow residents time

Myth: Every old city property is freehold.

A lot of central land is nazul or leasehold, with conditions attached to transfer and rebuilding.

Myth: A civil court can divide family farmland.

Division of agricultural holdings is a revenue court suit under the Revenue Code.

Myth: The High Court only sits in Prayagraj.

The Lucknow Bench sits permanently and hears cases from the Awadh districts.

Myth: A verbal tenancy is fine.

The 2021 law expects every tenancy to be written down and reported to the Rent Authority.

Myth: Only a registered will counts.

A properly witnessed will is valid without registration; registering it helps against later challenges.

Lucknow land and court vocabulary

Khatauni
The record of rights showing who holds each agricultural plot and in what capacity.
Khasra
The plot-by-plot field book giving area, crops and land use.
Bhumidhar
A holder of agricultural land with rights recognised under the Revenue Code, usually transferable.
Dakhil kharij
Mutation, the change of name in revenue records after a transfer.
Varasat
