A large share of civil work in Lucknow comes from land and house disputes within families, unpaid loans between friends or business contacts, encroachment by neighbours, and quarrels over boundaries in fast-growing localities on the city's edges. Traders and suppliers bring claims for unpaid invoices, while tenants and landlords come with disputes over rent and possession. Many people also need an urgent injunction to stop a construction, a sale or a demolition while the main dispute is decided. Families sharing ancestral houses in the older parts of the city often face partition and possession questions that have been left unresolved for a generation.
The Code of Civil Procedure, 1908 governs how a suit is filed, served, tried and decided. The Specific Relief Act, 1963 deals with injunctions, declarations and specific performance of contracts, and the Limitation Act, 1963 sets deadlines that are applied strictly. Most suits for money recovery must be filed within three years of the debt falling due, and a suit filed late can be dismissed whatever its merits. Where a claim is based on a written contract, a cheque or a bill of exchange, a summary suit under Order XXXVII CPC can lead to a quicker decree.
Disputes between businesses above the specified value fall under the Commercial Courts Act, 2015, which requires pre-institution mediation under Section 12A unless urgent interim relief is sought. Commercial suits also follow tighter timelines for written statements and case management. Even in ordinary civil matters, courts in Lucknow encourage settlement through mediation and Lok Adalats, which can save years of litigation when both sides are willing to talk. A settlement recorded before a Lok Adalat is treated as a decree and cannot ordinarily be appealed.
Civil suits from the city are filed at the District and Sessions Court (Civil Court), Lucknow, where Civil Judges of the Junior Division and Senior Division hear matters according to their value, and the District Judge hears certain appeals and special proceedings. Commercial disputes of specified value are heard by the Commercial Court constituted for the district. Suits must be filed in the court within whose local limits the defendant lives or works, or where the cause of action arose, and suits about immovable property go to the court where the property is located.
First appeals from the decrees of lower civil courts lie to the District Judge or to the Allahabad High Court, Lucknow Bench, depending on the value of the suit. Second appeals on substantial questions of law, and petitions against orders of the civil courts, are heard by the Lucknow Bench for districts within its jurisdiction. Revenue matters about agricultural land usually go to revenue courts under the Uttar Pradesh Revenue Code, 2006 rather than to civil courts, and your advocate will confirm the correct forum.

For most debts and dues, the limitation period is three years from when the amount became payable. A written acknowledgment of the debt or a part payment can extend the period, so keep such evidence safe. Courts look closely at the dates, so note when each payment was due and when any acknowledgment was signed.
Most suits are filed at the District and Sessions Court (Civil Court), Lucknow, before a Civil Judge chosen by the value of the suit. Commercial disputes above the specified value go to the Commercial Court, and your advocate will confirm the correct court.
You can file a suit for injunction with an application for a temporary injunction. The court looks at whether you have a prima facie case, whether delay would cause irreparable harm, and which side would suffer more. Photographs, a site plan and proof of your title or possession make the application much stronger.
A summary suit under Order XXXVII CPC is available for claims based on written contracts, bills or cheques. The defendant must seek leave to defend, and if no real defence is shown, the court can pass a decree quickly.
For commercial disputes not seeking urgent interim relief, pre-institution mediation under Section 12A of the Commercial Courts Act is required. For other civil matters it is optional, but courts often refer parties to mediation.
If the other side does not pay or hand over possession, you file an execution petition. The court can attach property, order arrest in limited cases, or deliver possession through its officers. Execution should be filed promptly, since a long delay gives the judgment debtor time to transfer assets.
