Civil suits, recovery, injunctions and declarations in Chennai

Civil disputes in Chennai cover a wide range of everyday problems. A supplier has not paid for goods delivered months ago. A relative has stopped you from using a shared staircase. A landlord refuses to return a security deposit. A neighbour has started construction that blocks your access. Many people also come with a cheque that bounced and a debt that remains unpaid even after the criminal case. Each of these is a matter of private rights, and the remedy is usually money, a court order to do or stop doing something, or a declaration of who owns what. Shop owners in older commercial areas also bring disputes about shared walls, drainage and rights of way that have been informally settled for decades and suddenly become contested when one side redevelops.

The Code of Civil Procedure, 1908 lays down how a suit is filed, how the other side is summoned and how evidence is led. The Specific Relief Act, 1963 allows the court to order performance of a contract, grant injunctions or declare a person's title. For recovery of money based on written contracts, bills of exchange or cheques, a summary suit under Order XXXVII CPC can be faster, because the defendant must first obtain leave of the court to defend. A declaration suit asks the court to state the legal position, for example that a sale deed executed by someone without authority does not bind you, and it is often combined with a prayer for a permanent injunction.

Commercial disputes above a specified value go to Commercial Courts under the Commercial Courts Act, 2015, which require pre-institution mediation in most cases where no urgent relief is sought, and set strict timelines for written statements. The Limitation Act, 1963 is unforgiving: most money recovery suits must be filed within three years, and a suit filed late can be dismissed whatever its merits. Because of this, the dates on your documents, the last acknowledgement of the debt in writing and the last payment received are often the first things an advocate will look at.

Main law: Code of Civil Procedure, 1908; Specific Relief Act, 1963; Limitation Act, 1963; summary suits under Order XXXVII CPC; Commercial Courts Act, 2015 for commercial disputes of specified value.

Where these matters are heard in Chennai

Chennai has an unusual arrangement. The City Civil Court, Chennai, which functions within the Madras High Court campus, hears most ordinary civil suits arising inside the city. At the same time, the Madras High Court retains original civil jurisdiction for some matters within the city, so suits of higher value may be filed directly on the Original Side of the High Court. The value of the suit and its nature decide the forum, and your advocate will confirm the correct court. Commercial disputes of specified value go to the designated Commercial Courts or the Commercial Division of the High Court.

Appeals from decrees of the City Civil Court lie to the Madras High Court, either before a single judge or a division bench depending on the value. An Original Side decree of the High Court is appealed to a division bench of the same court, and from there a special leave petition can be filed in the Supreme Court. For suburbs outside city limits, suits are filed in the district or subordinate courts of the neighbouring districts, so the location of the property or the defendant's residence must be checked before filing. Revision petitions against interlocutory orders and civil miscellaneous appeals against orders on injunction applications are also heard by the High Court.

How a civil matter usually moves in Chennai

  1. Send a legal notice
Most civil disputes begin with a legal notice setting out the claim and giving the other side time to respond. A reply, or silence, often shapes the case that follows.
  2. Try mediation where required
For commercial disputes without urgent relief, pre-institution mediation under Section 12A of the Commercial Courts Act is mandatory. Even in other suits, the court may refer the parties to mediation.
  3. Draft and file the plaint
The plaint states the facts, the relief claimed and the value of the suit, with court fee paid under Tamil Nadu court-fee rules. Supporting documents are filed along with it.
  4. Seek interim relief if urgent
If property is at risk of being sold or construction must be stopped, an application for temporary injunction can be moved at the time of filing. The court may grant an order before hearing the other side in genuinely urgent cases.
  5. Pleadings and evidence
The defendant files a written statement, issues are framed and both sides lead evidence through affidavits and cross-examination. Documents not filed in time may be refused later.
  6. Judgment and execution
After arguments the court passes a decree. If the losing side does not comply, an execution petition is filed to attach property or bank accounts.

Documents to keep ready

  • Written agreement or contract
  • Invoices, bills or purchase orders
  • Bank statements showing payments
  • Emails, letters and WhatsApp messages
  • Copy of the legal notice and reply
  • Dishonoured cheque and bank memo
  • Property documents if the dispute concerns land
  • Photographs of construction or encroachment

Mistakes to avoid

  • Do not wait close to the three-year limit before acting on an unpaid dues claim.
  • Do not skip pre-institution mediation in a commercial dispute where it is mandatory.
  • Do not undervalue a suit to save court fee, since it can lead to rejection of the plaint.
  • Do not rely on oral promises without keeping messages or witnesses to support them.
  • Do not ignore a summons, as the court can proceed ex parte and pass a decree against you.

Chennai: local points to know

Choosing and working with an advocate

Pick an advocate who regularly practises in the City Civil Court and on the Original Side of the Madras High Court, because procedure on the Original Side has its own rules and listing practices. Verify the advocate's enrolment number with the Bar Council of Tamil Nadu and Puducherry. Ask how the advocate plans to handle interim relief and how long the matter may realistically take at each stage. A good first meeting usually involves the advocate reading the documents, identifying gaps in evidence and explaining which relief is realistic. Be candid about weak points, such as missing receipts or an unsigned agreement, because the other side will raise them.

Civil cases can run for a long time, so agree in writing on the fee and what it covers, such as drafting, each hearing, evidence and execution. Fees depend on the advocate and the matter. Keep receipts for all payments and copies of every document filed. Mara Vakil helps you find enrolled advocates and book a free consultation and charges clients nothing to find or consult advocates.

Questions people ask about civil matters in Chennai

Which court should I approach for a money recovery suit in Chennai?

It depends on the value of the claim and whether the dispute is commercial. Ordinary suits usually go to the City Civil Court, higher-value suits may go to the Madras High Court's Original Side, and commercial disputes go to the Commercial Courts. Your advocate will confirm the right forum.

What is a summary suit?

A summary suit under Order XXXVII CPC is available for claims based on written contracts, cheques and similar instruments. The defendant cannot defend unless the court grants leave, which makes the process faster than an ordinary suit.

How long do I have to file a civil suit?

Under the Limitation Act, most money recovery suits must be filed within three years from when the money became due. Other claims have different periods, so check the limitation as soon as the dispute arises.

Can I get a stay on construction quickly?

Yes, a temporary injunction can be sought along with the suit. The court considers whether you have a prima facie case, whether the balance of convenience favours you and whether you would suffer irreparable harm without the order. If the order is granted without notice, the court usually lists the matter again soon so that the other side can be heard.

Is mediation compulsory before a civil case?

For commercial disputes under the Commercial Courts Act where no urgent interim relief is sought, pre-institution mediation is mandatory. In other civil cases, the court may refer parties to mediation at any stage.

What happens after I win a decree?

If the other side does not pay or comply, you file an execution petition. The court can attach bank accounts, salary or property, or order the delivery of possession, to enforce the decree. Execution has its own time limit, generally twelve years from the decree, but acting promptly makes recovery easier.
