Saket Courts, opened in 2010 next to Pushp Vihar, hear civil and criminal cases from the South and South East districts of Delhi, from Mehrauli and Malviya Nagar to Lajpat Nagar, Kalkaji and Badarpur. Here is what is heard there, where the offices are, how South Delhi property, family and cheque cases are handled, how to check your case online, and how to pick an advocate who appears at Saket every day. Share your matter in the form and an enrolment-checked advocate who practises at Saket can call you, at no cost to you.
Saket District Courts, on Press Enclave Marg in Saket (New Delhi 110017), are the court complex for Delhi's South and South East judicial districts. Opened on 28 August 2010, the complex has 128 courtrooms in three blocks and took over cases that earlier went to Patiala House. FIRs from police stations in these districts, and civil disputes about property or people there, are heard at Saket, up to Rs 2 crore in value for civil suits. Legal aid is free at the South and South East district legal services offices in the complex. Check your court and next date by CNR number on the eCourts app before you go, and choose an advocate who appears regularly in the court that has your case.

Until 2010 people from South Delhi travelled to Patiala House, near India Gate, for their cases. As the southern half of the city filled with new colonies, from Vasant Kunj to Sangam Vihar, that building could not cope. The Saket complex was planned to take over the South and South East districts and was expected to open in December 2009; it finally began work on 28 August 2010. Civil and criminal files of the two districts were shifted from Patiala House in one move, and Patiala House was left with the New Delhi district.
Saket was built as a modern complex: centrally air-conditioned, with lifts and ramps on every level, separate blocks for courts, administration and lawyers' chambers, and basement parking. It remains one of the busiest court complexes in the country, because South and South East Delhi together hold a large share of the city's population, its most expensive property, and a steady flow of matrimonial and commercial disputes.
For criminal matters the deciding factor is the police station that registered the FIR. For civil suits it is usually where the property is, where the defendant lives or works, or where the dispute arose. Broadly:
| District | Typical localities |
|---|---|
| South | Saket, Malviya Nagar, Hauz Khas, Green Park, Mehrauli, Chhatarpur, Neb Sarai, Sainik Farms, Sangam Vihar, Ambedkar Nagar, Fatehpur Beri and nearby villages |
| South East | Lajpat Nagar, Defence Colony, Kalkaji, Govindpuri, Greater Kailash, Chittaranjan Park, Okhla, Jamia Nagar, Sarita Vihar, Jaitpur, Badarpur, New Friends Colony and Nizamuddin |
Police and judicial district lines do not follow colony names exactly, and some areas that sound "South" belong elsewhere: Vasant Kunj and Vasant Vihar, for example, usually go to the South West district at Dwarka, and Chanakyapuri to New Delhi at Patiala House. Confirm by the police station named in your FIR or by the property's address on the eCourts portal before you travel.
| Court | Work |
|---|---|
| Principal District and Sessions Judges and Additional Sessions Judges (South and South East) | Sessions trials such as murder, rape and serious robbery, criminal appeals and revisions, anticipatory bail |
| Additional Chief Metropolitan Magistrates and Metropolitan Magistrates | Remand, bail, trials of magistrate cases, complaint cases, domestic violence applications |
| Digital courts for cheque cases | Six of Delhi's 34 courts for Negotiable Instruments Act complaints, set up in June 2025, sit at Saket |
| District Judges and Additional District Judges | Civil suits above Rs 3 lakh and up to Rs 2 crore, probate and succession, civil appeals |
| Senior Civil Judges and Civil Judges | Suits up to Rs 3 lakh, small injunction and declaration suits |
| Commercial courts | Business disputes of Rs 3 lakh and above within the district courts' limit |
| Rent Controllers | Eviction and rent disputes under the Delhi Rent Control Act |
| Family courts | Family courts for both districts; the citizen charter describes them in a building adjacent to the complex, with child-friendly rooms |
| Motor Accident Claims Tribunals | Road accident compensation |
| Special and fast-track courts | Courts notified for particular laws, such as sexual offences against children |
Consumer complaints, labour disputes and juvenile matters are heard by other bodies, not at Saket.
South Delhi property is expensive, and that matters for where a civil case is filed. Delhi is one of the few places where the High Court has original civil jurisdiction: a suit valued above Rs 2 crore is filed directly in the Delhi High Court, not in a district court. A partition suit over a house in Greater Kailash or a farmhouse dispute in Chhatarpur can easily cross that line, while a dispute over a flat in Sarita Vihar or a plot in Sangam Vihar usually stays at Saket.
| Value of the suit | Where it is filed |
|---|---|
| Up to Rs 3 lakh | Civil Judge at Saket |
| Above Rs 3 lakh and up to Rs 2 crore | District Judge or Additional District Judge at Saket |
| Above Rs 2 crore | Original side of the Delhi High Court |
The value is worked out under the court fee and suits valuation rules and depends on the relief. For possession and partition it is generally tied to the market value of the property or the plaintiff's share. Getting the valuation right at the start avoids the plaint being returned for filing in the other court months later. Rent control petitions, family cases and criminal cases are not affected by this line; they stay at Saket whatever the money involved.
With 128 courtrooms spread across the North, South and East wings of the main building and other blocks, "Saket court" is not an address. Before you set out, find three things: the court's designation, the presiding officer's name, and the room number.
Many advocates at Saket have chambers in the lawyers' block of the complex and spend the whole working day moving between courtrooms. When you choose one, look past the visiting card.
Fill in the form at the top of this page with a few lines about your matter. Delhi advocates on Mara Vakil who take such cases, each with checked enrolment, see the request but not your phone number. When one accepts, they call you. You pay nothing for this; any fee for the legal work is between you and the advocate you engage. You can also read how to choose an advocate or browse lawyers in Delhi.
Matrimonial cases are a large part of Saket's work. The family courts of the South and South East districts hear divorce, judicial separation, maintenance, custody, guardianship and related petitions, while protection and residence applications under the 2005 domestic violence statute are heard by the Metropolitan Magistrates in the main building.
Since the Supreme Court's judgment in Rajnesh v. Neha (2020), both spouses in a maintenance case must file an affidavit disclosing their assets, liabilities, income and expenses in a prescribed format. Family courts at Saket insist on this before deciding interim maintenance. In South Delhi, where incomes often include business earnings, rent and investments, the affidavit is frequently the battleground. Prepare it carefully with bank statements, tax returns and property details; concealment can count against you. The same judgment says maintenance is generally payable from the date of the application.
Couples who agree file a joint petition under section 13B of the Hindu Marriage Act (or the equivalent provision of their personal law) and appear for their statements. By statute, six months must normally pass between the first and second motions, but the Supreme Court in Amardeep Singh v. Harveen Kaur (2017) allowed family courts to waive it where the couple has been separated for long and all issues are settled. In Shilpa Sailesh v. Varun Sreenivasan (2023) a Constitution Bench held that the Supreme Court itself can dissolve a marriage that has irretrievably broken down. Family courts at Saket regularly refer couples to mediation to finalise terms on alimony, custody and the return of belongings before the joint petition.
Custody is decided on the child's welfare, not on which parent is wealthier. The court may speak to the child, call for a counsellor's report, and fix visitation, including video calls for a parent living abroad. Child-friendly rooms in the family courts are used for meetings.
Under the Hindu Marriage Act a divorce petition may be presented in the district of the wedding, the district where the spouses last stayed under one roof, or, if the wife is the petitioner, the district where she resides when filing. When any of these lies in the South or South East district, Saket's family courts can hear it. See divorce lawyers in Delhi, family lawyers in Delhi and how to file for divorce.
South and South East Delhi have every kind of property: DDA flats, builder floors in old colonies, farmhouses, urban villages, and unauthorised colonies. Each brings its own disputes to Saket.
In colonies such as Sangam Vihar, much property changed hands through general power of attorney, agreements to sell and wills rather than registered sale deeds. In Suraj Lamp and Industries v. State of Haryana (2011) the Supreme Court held that such documents do not transfer ownership. Under the PM-UDAY scheme, people living in notified unauthorised colonies may obtain a conveyance deed or an authorisation slip from the DDA, documents that greatly improve the strength of their claim. Disputes over possession, forged documents and family claims in these colonies are a staple of the civil courts at Saket.
Villages such as Mehrauli, Lado Sarai, Chhatarpur and Saidulajab include lal dora or abadi land, where revenue records may be thin. Proof of possession, old house tax records and family partition papers become important when ownership is challenged.
Many old South Delhi houses have been rebuilt as builder floors under collaboration agreements. Disputes between families and builders, and among siblings over floors, often reach the courts as suits for specific performance, partition or injunction. Check the value: if the property is worth more than Rs 2 crore, the suit goes to the High Court.
Older tenancies with rent up to Rs 3,500 a month, still found in markets such as Lajpat Nagar and Kalkaji, are governed by the Delhi Rent Control Act and come before the Rent Controllers at Saket. Most newer tenancies, with higher rent, fall outside that Act and are recovered through civil suits. See property lawyers in Delhi and the Delhi stamp duty calculator.
Criminal cases registered at police stations in the South and South East districts are tried at Saket. Since 1 July 2024 new FIRs use the Bharatiya Nyaya Sanhita and the Bharatiya Nagarik Suraksha Sanhita (BNSS); older cases continue under the Indian Penal Code and the old procedure code.
The police have 24 hours from arrest to bring the person before a magistrate. At Saket this is the magistrate attached to the police station, or the duty magistrate on holidays. Each criminal court has a legal aid lawyer on duty, the remand advocate, who represents without charge anyone produced without counsel. The magistrate decides on police or judicial custody and can hear a bail application on the spot.
Alongside theft, assault and dowry cases, the South and South East districts see many cyber fraud complaints, cases involving offices and businesses in Okhla and Nehru Place, and matrimonial cruelty complaints. Each district has a cyber police station; online fraud victims should report on 1930 and the national cybercrime portal at once. For help, see criminal lawyers in Delhi, bail lawyers in Delhi, cyber lawyers in Delhi and the bail application guide.
Write to the Station House Officer and then the Deputy Commissioner of Police of the district. If that fails, apply to the magistrate at Saket under section 175(3) of the BNSS for a direction to register and investigate, attaching proof that you approached the police.
When the Delhi High Court opened 34 digital courts for Negotiable Instruments Act cases in June 2025, six went to Saket. These courts work largely online, with e-filing, virtual hearings and digital records, so parties and advocates do not always need to be present in person.
Tools: cheque bounce calculator and cheque bounce notice. Pending cases can be settled at the Lok Adalat on 25 October 2026.
Claims for accidents within the two districts are heard by the Motor Accident Claims Tribunals at Saket. The police file a detailed accident report with the tribunal, which can be treated as the claim itself. Keep medical bills, income proof and the FIR ready, and consider settling with the insurer at a Lok Adalat if the offer is fair.
For unpaid invoices, loans backed by written acknowledgments or dishonoured cheques, a summary suit under Order XXXVII of the Civil Procedure Code puts the burden on the defendant to show a real defence. Send a legal notice first; see legal notice.
Businesses in Okhla, Nehru Place and the South Delhi markets bring contract, supply and partnership disputes to the commercial courts at Saket when the value is between Rs 3 lakh and Rs 2 crore. Unless urgent interim relief is needed, the Commercial Courts Act requires an attempt at mediation through the legal services authority before the suit is filed, and the written statement must be filed within strict time limits.
The main building holds most courtrooms in its North, South and East wings, with the Principal District and Sessions Judges' courts in the Central Hall. The Administrative Block houses the copying agencies on the ground floor, the Nazarat on the second floor and the record rooms on the third floor. The Utility Block has the bank, ATM and some offices, and the Lawyers' Chamber Block has the canteen, post office, typists and photocopy shops.

Every level has ramps and wheelchair-accessible lifts, and wheelchairs are available on request. Security at the entrances checks bags and visitors; carry a photo ID. Firearms and other dangerous items are banned, and photography or recording inside courtrooms is not allowed. Security at Delhi's court complexes was tightened after shooting incidents in recent years, including one at Saket in April 2023, so expect thorough checks.
The South District and the South East District each have their own page on the national eCourts district portal, and both are covered by the eCourts services app.
If you fear that the other side will approach the court behind your back, for example to get an injunction over a property or a stay of your eviction order, you can file a caveat so that you are heard before any order is passed. The district portals publish email IDs for caveat filing. A caveat lasts 90 days.
Plaints, petitions and applications in many categories can be filed through the national e-filing portal, with fees paid online. The digital cheque bounce courts at Saket run largely online, and other courts may permit video appearance on request, for example for a party who lives abroad.
South DLSA (Room 309, third floor) and South-East DLSA (ground floor, Utility Block) provide free lawyers through their panels, advice at front offices, remand advocates in criminal courts, help with appeals for convicts, victim compensation, and support in accident claims. In Delhi, women, children, SC and ST members, persons in custody, persons with disabilities and several other groups qualify without an income test; others qualify with annual income up to Rs 3 lakh, or Rs 4 lakh for senior citizens and transgender persons. The 24-hour helpline is 1516. Use the eligibility checker to see where you stand.
Saket has a mediation centre where trained mediators, many of them lawyers, help parties settle family, property, money and business disputes, whether a case is pending or not. Settlements are confidential and enforceable, and court fee paid on a pending suit is refunded when it settles in mediation. Family courts at Saket refer most matrimonial cases there at an early stage.
Saket is one of the seven district complexes where the National Lok Adalat sits on Sunday, 25 October 2026. Ask your court now to list a pending cheque bounce, accident, recovery or non-divorce family case, or apply to the DLSA for a pre-litigation matter at least a week ahead. Traffic challans need a slip from the Delhi Traffic Police portal, open from 19 October. Full details in the Delhi Lok Adalat guide.
These composites use invented names, but the paths they follow are the ones Saket litigants commonly take.
Ritu filed for maintenance at the South East family court. Her husband, who ran a garment export business from Okhla, declared a modest salary. Using the Rajnesh v. Neha affidavit format, her advocate pointed to his company's turnover, rent from a builder floor and foreign travel. The court fixed interim maintenance on a realistic estimate of his income and referred the couple to mediation, where they later agreed on a lump sum.
Mohammad Irfan had bought a house in 2009 through a GPA and agreement to sell. When the seller's son claimed it, Irfan's advocate filed a suit for declaration and injunction at Saket, relying on possession, payment records and the PM-UDAY authorisation slip Irfan had obtained from the DDA. An interim injunction protected his possession while the suit proceeded.
A college student was arrested after a fight outside a café. He was produced before the magistrate at Saket the next day. The remand advocate argued for bail; the family's own advocate joined in the afternoon with his college identity card and his father's surety documents. The magistrate granted bail with conditions the same day.
The owner of a small shop let at Rs 900 a month since the 1980s needed it for his son. His advocate filed an eviction petition before the Rent Controller at Saket on the ground of bona fide requirement. The tenant's application for leave to defend was dismissed, and an eviction order followed within months.
A packaging supplier had invoices unpaid for a year. After a legal notice, the mandatory pre-institution mediation failed when the buyer did not turn up, and the supplier filed a commercial summary suit at Saket. Faced with the need to show a real defence, the buyer agreed to pay in instalments, recorded as a decree.
A landlord's tenant paid three months' rent by a cheque that bounced. The landlord sent a notice, then filed a complaint that went to one of Saket's digital cheque courts. The tenant used the online payment link in the summons, and the case closed without a single physical hearing.
Two brothers disputed a Chhatarpur farmhouse worth far more than Rs 2 crore. Their advocates explained that Saket could not hear the partition suit because of its value; it was filed on the original side of the Delhi High Court instead, where it was referred to the High Court's mediation centre.
Any woman can get a free legal aid lawyer at Saket, whatever her income. For violence at home, a protection officer can help file a domestic violence application, and the magistrate can pass urgent protection and residence orders. In sexual offence trials, the survivor's identity is protected and her evidence can be recorded in a way that spares her from facing the accused.
Many older people in South Delhi live alone in houses that children or tenants want. Apart from civil suits, the Senior Citizens Act offers a faster route through the maintenance tribunal for maintenance and protection, and can lead to removal of abusive relatives from the home. Courts at Saket also give priority to elderly litigants on request, and the higher legal aid income limit of Rs 4 lakh applies to senior citizens. See the bedakhli process guide.
South Delhi has many families with members abroad who own property here or are parties to matrimonial cases. A power of attorney attested at an Indian mission, or apostilled where applicable, lets a relative act in civil matters. Your advocate can apply for your evidence to be recorded by video, and for exemption from personal appearance on routine dates. In criminal cases, attendance is required more strictly, so plan with your advocate.
Businesses appear through an authorised officer with a board resolution or authority letter. Keep invoices, ledgers, emails and purchase orders organised; commercial courts expect documents to be filed with the plaint and penalise late filing.
People from Mehrauli to Badarpur look for advocates who appear at Saket, often the same day their matter arises. A free, enrolment-checked profile on Mara Vakil lists your courts and areas of practice in factual terms, within what the Bar Council of India's rules allow: no ratings, no rankings and no paid placement. Requests in your areas reach you; you choose which to accept, and Mara Vakil takes no share of your fee.
Use the form at the top of this page, or talk to an advocate. It is shown to enrolment-checked Delhi advocates on Mara Vakil who take such matters, and whoever accepts it rings you. There is no charge to you, and the legal fee is agreed between you and the advocate. If you cannot afford a lawyer, the South and South East legal services offices in the complex will assign one free.

| Anticipatory bail | Notice to police, then a decision over a few hearings; interim protection may be given |
| Interim maintenance | A few months, once both affidavits are filed |
| Mutual consent divorce | About six months, sooner if the waiting period is waived |
| Cheque complaint where the accused pays early | Weeks to a few months |
| Rent eviction on bona fide need | Months, through the summary procedure |
| Contested civil suits and trials | Often several years |
These are general patterns, not promises. Adjournments, the number of witnesses and the court's list all affect the timeline. Settlement through mediation or a Lok Adalat is usually the quickest way to finish.
| If your matter is | Carry |
|---|---|
| Arrest and bail | FIR and arrest memo copies; the accused's Aadhaar, address proof and job or study proof; the surety's ID and proof of property or salary |
| Maintenance | Marriage photos or certificate, children's birth certificates, salary slips or tax returns of both sides, bank statements, a list of monthly expenses, and the asset and liability affidavit |
| Mutual divorce | Marriage proof, both spouses' ID and address proof, recent photographs, and the signed settlement terms |
| Possession or partition | Sale deed, GPA or agreement to sell, conveyance deed or PM-UDAY slip, mutation, house tax receipts, electricity bills, site plan and photographs |
| Rent eviction | Ownership proof, rent receipts or agreement, and evidence of the ground, such as your family's need for the premises |
| Cheque complaint | Original cheque and return memo, notice with postal or courier proof and tracking, proof of the underlying debt |
| Accident claim | FIR, detailed accident report if available, hospital records and bills, income proof, details of the vehicle and insurer |
| Commercial dispute | Contract or purchase orders, invoices, ledgers, emails and WhatsApp messages exported with dates, and the mediation failure report |
The advocate's fee is the main cost and is agreed with the advocate. Smaller expenses come up along the way: court fee on plaints and applications, process fee for summons, attestation of affidavits, typing and copies, certified copies of orders, travel and, for some matters, a valuer's or handwriting expert's fee. In property suits the court fee can be significant because it depends on the value claimed. Ask your advocate for an estimate of these at the outset and keep every receipt.
A calm, prepared litigant helps the case move. Courts notice when parties come ready.
South Delhi residents and shop owners often receive official notices before any case begins: a municipal notice about unauthorised construction or misuse, a DDA letter about conversion or lease terms, a police notice asking them to join an investigation, or a bank's recovery notice. How you respond at this stage can decide whether you end up in court.
An advocate can draft a reply that preserves your defences. Many disputes end at this stage.
A single marriage breakdown in South Delhi often produces several cases in different courts at once. Understanding how they connect helps you plan.
| Proceeding | Court at Saket | What it decides |
|---|---|---|
| Maintenance for wife and children | Family court | Monthly amount, interim and final, based on both incomes |
| Divorce, contested or mutual | Family court | Whether the marriage is dissolved, and often alimony and custody |
| Custody and visitation | Family court | Where the child lives and when the other parent meets the child |
| Domestic violence application | Metropolitan Magistrate | Protection, residence, monetary relief and custody orders |
| Criminal complaint for cruelty or dowry | Metropolitan Magistrate, after police investigation | Trial of the offence under the BNS (formerly section 498A IPC) |
| Return of stridhan and belongings | Magistrate or family court, depending on the case | Recovery of jewellery and articles |
Parallel cases can be tiring and expensive. Family courts refer couples to mediation, and when a full settlement is reached it usually covers every case: the maintenance and divorce petitions are disposed of on agreed terms, the domestic violence case is withdrawn, and the criminal case, if non-compoundable, is quashed by the Delhi High Court on the basis of the settlement. Make sure any settlement deed lists every pending case by number, sets out payments and timelines, and says what happens if a party backs out.

| Salary not paid or wrongful termination of a worker | Labour authorities and labour courts |
| Bank wants to take over a mortgaged house | Debt Recovery Tribunal for objections under the recovery law |
| Neighbour's construction damaging your wall | Civil court at Saket for injunction and damages, and the municipal authority |
| Elderly parent being harassed by a son for the house | Senior citizens' maintenance tribunal, and civil or criminal remedies at Saket |
| Online fraud from your account | Cyber police station and 1930 first; court later if needed |

Choosing the right forum first saves months. When in doubt, ask an advocate before filing anything.
Courts at Saket usually take up matters from 10 am, rise for lunch in the early afternoon, and continue until the day's list is done or the afternoon session ends. Filing, copying and inspection counters keep office hours that are shorter than the courts' sitting hours, so finish paperwork early in the day. Delhi's district courts close on gazetted holidays and follow the annual calendar issued by the Delhi High Court, which also declares certain Saturdays as working days; 31 October 2026 is one of them. During the summer and winter breaks, vacation courts sit for urgent matters such as bail and interim injunctions.
