When a succession certificate is the right route

  • The person has died and left movable assets that are debts or securities, such as fixed deposits, savings account balances, shares, debentures, mutual fund units, bonds, or money owed to them by someone.
  • It is generally used when there is no will. Where there is a will, probate or letters of administration may be needed instead, depending on the place and the asset.
  • It is not used for land, houses or flats. Immovable property passes under personal succession law or a will, and is dealt with by mutation, partition or other steps.
  • The petition is filed before the District Judge of the area where the deceased ordinarily lived at the time of death, or where the property is if they had no fixed residence.
  • The petition must list all heirs with their relationship and addresses, and every asset for which the certificate is sought with its value.
  • The court may ask the petitioner to give a security bond or surety, so that if someone with a better claim comes forward later, the money can be recovered.

What affects the total cost

  • Court fee: this is charged as a percentage of the total value of the debts and securities listed in the petition, so a higher estate value means a higher court fee.
  • Newspaper publication: the court usually orders a citation to be published in a newspaper so that anyone with an objection can come forward.
  • Security bond and surety: the court may require a bond with one or more sureties, which may mean arranging a surety and their property or salary documents.
  • Number of heirs and their consent: if all other heirs give a no-objection affidavit, the case is simpler. If anyone objects, the case becomes contested and takes longer.
  • Valuation papers: getting statements of share holdings, mutual fund values or bank balances as on the date of death may involve requests to each institution.

How long it takes

Collecting asset statements, heir details and consents usually takes two to three weeks. After the petition is filed, the court issues notice to the heirs and orders a public citation in a newspaper, and then waits for a fixed period for objections. If no one objects and all heirs consent, the court records evidence, usually by affidavit, and grants the certificate, often within three to six months in total. Contested petitions, missing heirs, mismatched names in records and adjournments can push this much longer.

Common mistakes to avoid

  • Assuming the nominee owns the money. A nominee mainly receives the asset on behalf of the legal heirs, and the heirs can still claim their share under succession law.
  • Leaving out an asset from the petition and then needing a fresh application or an extension of the certificate later.
  • Not listing all heirs, which can lead to objections or revocation of the certificate.
  • Filing in the wrong court, such as where the heir lives instead of where the deceased ordinarily lived.
  • Applying for a succession certificate when the bank would have settled a small amount on a simpler claim form and indemnity. Ask the bank about its settlement process first.

What you get at the end

You receive a certified copy of the succession certificate, which names the person or persons authorised to collect the listed debts and securities. Submit it with the claim form to each bank, registrar and transfer agent, depository participant or company. Once it pays, the institution is protected from later claims. The person who collects the money holds it for all heirs as per law, so record the distribution in writing among the family.

In Delhi NCR

  • In Delhi, succession petitions are filed in the district court that covers the area where the deceased lived, such as the courts at Tis Hazari, Saket, Karkardooma, Rohini, Dwarka or Patiala House.
  • For estates of very high value, the petition may need to be filed in the Delhi High Court instead of a district court because of pecuniary limits. The advocate checks this before filing.
  • If the deceased lived in Gurugram or Faridabad, the petition goes to the district court there under Haryana court fee rules, and for Noida or Ghaziabad to the district court in Uttar Pradesh.
  • Delhi courts allow filing and many hearings online, which helps heirs who live in other cities. Some appearances or original signatures may still be required.
  • If the deceased lived outside NCR, the team can guide you online on documents and help you understand the process in that district.

Frequently asked questions

Do I have to pay to book Succession Certificate?

No. Booking is free and no payment is taken on the website. A team member calls you, explains the work and the total cost, including any government fee, stamp duty or newspaper charges, and work starts only after you agree.

How long does Succession Certificate take?

Usually 3 to 6 months. Timelines depend on government offices and courts. You can track your order online with your order ID.

What documents do I need?

Usually: Death certificate; List of assets with account details; ID proof and relationship proof of heirs; No-objection from other heirs, if any. Our team confirms the exact list for your case on the call.

Who does the work?

This service needs an advocate, so the legal work is done by an independent advocate enrolled with a State Bar Council. Mara Vakil is a technology platform, not a law firm.

How do I track my order?

After booking you get an order ID. Open Track Order from the menu and enter the order ID and your mobile number to see every update.

Is a succession certificate needed if there is a nominee?

Often not for releasing the money, because the institution can pay the nominee. But the nominee generally holds it for the legal heirs. If the heirs disagree or the institution insists, a succession certificate may still be needed. It is also needed where there was no nomination at all.

Can one certificate cover all bank accounts and shares?

Yes. A single petition can list all debts and securities, such as accounts in different banks, shares in different companies and mutual funds, and one certificate can cover them all. Court fee is charged on the total value, so it helps to list everything at the start.

What if one heir does not agree?

Then the petition becomes contested. The objecting heir can file a reply, and the court may record evidence before deciding who should be given the certificate. In some cases the court grants it jointly to more than one heir. Family settlement before filing often saves time.

Can a succession certificate be revoked?

Yes. Under the Indian Succession Act, 1925 the court can revoke it if it was obtained by hiding facts, by fraud, or if it later becomes useless. This is why the petition should truthfully disclose all heirs and assets.

How is it different from letters of administration?

Letters of administration give the administrator authority over the entire estate of a person who died without a will, or whose will has no executor, including immovable property in some cases. A succession certificate is narrower and only covers collection of debts and securities. The advocate suggests the right one for your case.
