When you need this certificate

  • It is used when a family member has died and offices like the pension department, employer, insurer, bank, electricity or water department, or housing society ask for proof of who the surviving family members are.
  • It is a certificate of fact issued by the revenue authority after an inquiry. It names the heirs but does not decide disputes about who owns what property.
  • It is usually applied for by a spouse, child, parent or other close relative of the deceased, and the names of all heirs are listed, not only the applicant.
  • The application is made to the revenue office of the area where the deceased last lived permanently, not where the heirs live now.
  • If heirs disagree with each other, or someone claims under a will, the revenue office may refuse or delay the certificate, and a court route such as a succession certificate or probate may be needed.
  • Some banks and companies do not accept it for large amounts and ask for a succession certificate instead, so check with the institution first.

What affects the total cost

  • Government fee: in most states the application fee for this certificate is nominal or nil. The team confirms the current position for your state on the call.
  • Affidavits: each heir or the applicant may need an affidavit on stamp paper or e-stamp, and it may need notarisation or attestation by an Oath Commissioner.
  • Number of heirs: more heirs mean more ID proofs, affidavits and signatures to collect, especially when some live in other cities or abroad.
  • Missing documents: if a birth or death certificate is missing or has a spelling error, getting it corrected first adds time and some cost.
  • Travel for verification: an official may call the applicant or witnesses to the office, or visit the address, which can mean time off work.

How long it takes

Preparing the application and affidavits normally takes a few days once all heirs share their papers. After submission, the revenue office sends the file for local inquiry, where a field official may verify the family details with neighbours or ask for statements. This part usually takes two to five weeks. Delays commonly happen when names are spelt differently across documents, when one heir is not traceable, when the address of the deceased falls under a different revenue office than expected, or when someone objects. Some offices also issue a public notice and wait for objections before issuing the certificate.

Common mistakes to avoid

  • Leaving out a married daughter, a heir living abroad or a child from an earlier marriage. All legal heirs must be listed, and hiding one can lead to cancellation later.
  • Applying at the office where the applicant lives now instead of where the deceased last lived.
  • Using documents where the deceased's name or date of birth is spelt differently without explaining the difference in an affidavit.
  • Assuming that a legal heir certificate transfers property. It does not; property mutation and transfer need separate steps.
  • Not checking first whether the bank or company will accept a legal heir certificate, and later finding that it wants a succession certificate.

What you get at the end

You receive the certificate listing the heirs and their relationship to the deceased. Make a few attested copies and keep the original safe. Use it to claim family pension, gratuity, provident fund or insurance, transfer electricity, water and gas connections, update housing society records and request release of small bank balances. Each institution may ask for its own claim form and an indemnity bond from the heirs along with the certificate.

In Delhi NCR

  • In Delhi, certificates of this kind are issued through the office of the SDM of the revenue district where the deceased lived, and many such services are applied for online through the e-District portal at edistrict.delhigovt.nic.in.
  • Delhi offices may issue it as a legal heir or a surviving member certificate depending on the purpose, such as pension or utility transfer. The team checks which one your case needs.
  • Affidavits in Delhi are normally made on e-stamp paper, which is available through authorised SHCIL collection centres and their agents.
  • For a death in Gurugram or Faridabad, the application goes to the Haryana revenue office, and for Noida or Ghaziabad to the Uttar Pradesh revenue office. Each state has its own online portal and form.
  • If the deceased lived outside NCR, the team can guide you online on the forms and affidavits for that state, though local verification will happen there.

What is the difference between a legal heir certificate and a succession certificate?

A legal heir certificate is issued by the revenue office after an inquiry and simply names the surviving heirs. A succession certificate is granted by a civil court under the Indian Succession Act, 1925 and authorises collection of debts and securities like bank deposits and shares. Banks often need the court certificate for larger amounts.

Can a legal heir certificate be used to transfer a house or flat?

Not on its own. It shows who the heirs are, but transfer or mutation of immovable property depends on the local authority's rules and may need a relinquishment deed, partition, will, or probate. It is often one of the documents asked for in that process, along with others.

What if one of the heirs lives abroad?

That heir can sign the required affidavit or consent before the Indian embassy or consulate, or before a local notary with apostille, as accepted by the office. Their passport copy is usually used as ID proof. Planning this early avoids delays.

Can a married daughter be named as a legal heir?

Yes. Under the Hindu Succession Act, 1956, daughters are Class I heirs whether married or not, and similar principles apply in other personal laws in different ways. A married daughter must be included in the list of heirs if she is entitled by law.

Can the certificate be cancelled later?

Yes. If it later turns out that an heir was left out, or that facts were wrongly stated, the issuing authority can review or cancel it, and the affected person can also go to court. That is why giving complete and correct family details is important from the start.
