About Disinheritance (Bedakhli) Notice

Parents sometimes publish a public notice stating that they have disowned a son or daughter and will not be responsible for their acts or debts. Such a notice records the family's decision, but it does not by itself take away legal rights in ancestral property. An independent advocate explains what the notice can and cannot do before it is published.

What the notice can and cannot do

  • A disinheritance or bedakhli notice is a public statement by parents that they have broken ties with a son or daughter and will not be responsible for that person's acts, debts or dealings. No statute gives it a special legal status.
  • It does not take away a child's rights in ancestral or coparcenary property. Under the Hindu Succession Act 1956, a coparcener's share arises by birth and cannot be removed by a newspaper notice.
  • For the parents' self-acquired property, the clear way to exclude a child from inheritance is a properly made will. The notice can support the parents' intention, but the will is what decides succession.
  • Parents cannot disown the legal duty to maintain a minor child through a notice. The notice is meant for adult children.
  • Senior citizens facing harassment from a child may also have remedies under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, including applying to the Maintenance Tribunal. The notice is not a substitute for those steps.

What affects the total cost

  • Advocate's advice and drafting: an independent advocate explains the effect of the notice and drafts the wording.
  • Newspaper choice: one or two newspapers, usually one English and one Hindi, in the city where the family lives and where the child is likely to deal with others.
  • Length of the notice: details of property or of specific past acts make it longer.
  • Will drafting: if you also want to make or change a will to exclude the child from self-acquired property, that is separate work.
  • Tribunal or police steps: any application under the senior citizens law or a police complaint is separate from the notice.

How long it takes

The advice call and drafting usually take one or two working days, depending on how quickly the parents can share details and agree on the wording. Newspapers usually publish within one to three days of booking, so most notices appear within two to four days. Time goes up when both parents are not in agreement, when property details need checking, or when the family wants to make a will at the same time. It is worth taking a little time over the wording, because the notice is public and cannot be withdrawn once published.

Common mistakes to avoid

  • Believing the notice removes the child's share in ancestral property. It does not, and acting on that belief can lead to costly disputes.
  • Not making a will. If the aim is to keep self-acquired property away from a child, a valid will is essential.
  • Making allegations in the notice. Accusing the child of crimes or misconduct in public can invite a defamation complaint. Keep the wording factual and neutral.
  • Publishing in anger without both parents agreeing. A notice issued by one parent alone can be questioned and may cause further family conflict.
  • Forgetting to inform banks or business contacts. If the concern is misuse of the family's name or accounts, tell the people concerned directly as well.

What you get at the end

You receive copies of the published newspaper pages showing the notice, its date and the newspaper's name. Keep them safely with your will and property papers. If someone later tries to hold the parents responsible for the child's debts or dealings, the notice helps show that the public was told. It can also be shown to a police station, a bank or a Maintenance Tribunal as part of the background.

In Delhi NCR

  • In Delhi, applications by senior citizens under the Maintenance and Welfare of Parents and Senior Citizens Act are handled by the Maintenance Tribunal, usually headed by the SDM of the revenue sub-division, and the Delhi rules provide a process for protecting a senior citizen's residence.
  • Delhi notices are commonly published in Delhi editions of national English and Hindi newspapers, which also circulate in Gurugram, Noida and Ghaziabad.
  • If the family property is in Haryana or Uttar Pradesh, publish in an edition that reaches that area too, and check revenue records there.
  • Wills in Delhi can be registered at the sub-registrar office. Registration is optional but makes the will harder to challenge.
  • Outside NCR, the team can guide you online, and the advocate can draft a notice for your local newspapers where possible.

Can parents legally disinherit a son through a newspaper notice?

Not from ancestral or coparcenary property, where rights arise by birth. For self-acquired property, a parent can leave it to anyone through a will, so a properly made will is the effective step. The notice mainly records the decision and disclaims responsibility for the son's acts.

Will the notice stop banks from chasing us for our son's loan?

If the parents were not borrowers or guarantors, they are not liable for an adult child's loan anyway. The notice gives public intimation that the parents will not be responsible for future dealings. If you signed as a guarantor, the notice does not cancel that liability.

Can we ask our son to leave our house after the notice?

The notice alone does not give a right to evict. Senior citizens can apply to the Maintenance Tribunal under the senior citizens law, and the Delhi rules provide a process to protect their residence. In other cases, eviction needs legal proceedings. An advocate can advise on the right route.

Can a bedakhli notice be withdrawn later?

The published notice stays on record, but families do reconcile. Parents can publish a fresh notice stating that the earlier one stands withdrawn and the relationship is restored. If a will was changed, it should be updated as well. Keep copies of both notices together.

Should the notice mention the reasons for disowning?

It is usually safer to keep it short and neutral, for example that the son or daughter is not in the parents' control and the parents will not be responsible for their acts. Detailed allegations can lead to a defamation complaint and do not make the notice stronger.
