Mumbai's workforce ranges from bank and IT staff in BKC and Powai to mill, dock, hotel, security and domestic workers, and each group faces different employment problems and forums. This page explains how labour and employment disputes are raised and heard in Mumbai under the Labour Codes and Maharashtra law, and what to prepare before speaking to an advocate.
Industrial disputes in Mumbai are raised before the conciliation machinery of the labour department and then heard by the Labour Courts and Industrial Courts in Mumbai. Labour Lawyers in Mumbai advise on the law, draft the papers and appear for you. Booking a first consultation with an enrolled advocate through Mara Vakil is free.
Employees and employers in Mumbai bring a wide range of problems to labour advocates. Office staff at finance and technology companies are asked to resign overnight, have their full-and-final settlement withheld, or are told to pay back a training bond or notice pay. Workers in factories in Andheri MIDC and Marol, in printing and garment units, and in hotels and restaurants are terminated without inquiry or have wages cut. Security guards and housekeeping staff hired through contractors find that provident fund was deducted but never deposited. Women face sexual harassment at work and are unsure how to complain. Domestic workers and drivers employed by families want unpaid wages. Delivery riders and other platform workers want to know their rights, since the Code on Social Security recognises gig and platform workers for welfare schemes. Employers, on the other hand, want help with domestic inquiries, standing orders, retrenchment and compliance inspections.
The four Labour Codes, which came into force in November 2025, now form the main framework: the Code on Wages, 2019, the Industrial Relations Code, 2020, the Code on Social Security, 2020 and the Occupational Safety, Health and Working Conditions Code, 2020. They replace older laws such as the Industrial Disputes Act, 1947, the Payment of Gratuity Act, 1972 and the Payment of Wages Act, 1936, though disputes about earlier periods may still be decided under the older Acts. Gratuity is payable after five years of continuous service, and fixed-term employees become eligible after one year. Maharashtra has its own laws as well, including the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971, the Maharashtra Shops and Establishments Act, 2017 and the Mathadi Act for head-load workers. The POSH Act, 2013 requires an Internal Committee in workplaces with ten or more employees.
Industrial disputes in Mumbai are first taken to the conciliation machinery of the office of the Commissioner of Labour, Maharashtra, whose officers try to bring the employer and worker to a settlement. If conciliation fails, the dispute goes for adjudication before the labour adjudication bodies in Mumbai, which have traditionally been the Labour Courts and the Industrial Court, with the Industrial Relations Code moving adjudication to Industrial Tribunals as these are set up. Complaints of unfair labour practices under the Maharashtra MRTU and PULP Act have long been heard by the Labour Court and Industrial Court; how this state law operates alongside the new Code is something your advocate will check for your case.
Provident fund and ESI complaints are handled by the regional offices of the EPFO and ESIC in Mumbai. Sexual harassment complaints go to the employer's Internal Committee, or to the Local Committee for Mumbai City or Mumbai Suburban district. Managers and other non-workmen usually sue for unpaid dues or wrongful termination in the City Civil Court, or before a Commercial Court where applicable. Writ petitions against awards are filed in the Bombay High Court.
Challenges to illegal termination, forced resignation and withheld full-and-final settlements, through conciliation, adjudication or a civil suit depending on whether you are a worker under the Codes. Withheld experience and relieving letters are also commonly resolved here.
Complaints to the EPFO and ESIC about deductions not deposited, transfer and withdrawal problems, and gratuity claims before the competent authority. Contract workers can often look to the principal employer when the contractor defaults.
POSH complaints and Internal Committee proceedings, and for employers, domestic inquiries, standing orders, contract labour compliance and inspections. Clear written policies prevent many disputes from starting.
Labour work in Mumbai can involve conciliation officers, adjudication bodies, the EPFO, the civil courts and the Bombay High Court, so ask which of these the advocate regularly handles and whether they usually act for workers or for employers. Verify enrolment with the Bar Council of Maharashtra and Goa. Give your advocate the full employment history, including any warnings or performance issues, since the employer will raise them. Do not sign anything the employer offers while the dispute is going on without showing it to your advocate first, and keep a dated record of every meeting and call with HR.
Ask for the fee arrangement in writing and take receipts for every payment. It depends on your actual work. Employees doing mainly managerial or administrative work above the wage limit set by the Industrial Relations Code are generally not workers under the Code, so they usually rely on their employment contract in a civil court or arbitration. Clerical, technical and operational staff may qualify. Your advocate will assess your role.
Check your passbook on the EPFO portal. If contributions are missing, file a grievance online and a complaint with the EPFO regional office in Mumbai. The EPFO can assess and recover the dues from the employer with interest and damages. Contract workers can also hold the principal employer responsible in many cases.
An employer can claim notice pay if your contract requires notice and you did not serve it, but it should be a reasonable sum under the contract. Holding back documents for long periods is often challenged through a legal notice. Many such disputes in Mumbai settle after a notice is sent.
A bond may be enforced to the extent the employer shows a genuine loss, such as the cost of specialised training, and the amount is reasonable. Courts do not usually enforce a large sum that is really a penalty. Each bond is read on its own terms.
Complain in writing to your employer's Internal Committee, generally within three months of the incident. If the employer has fewer than ten employees or the complaint is against the employer, it goes to the Local Committee for Mumbai City or Mumbai Suburban district. You can also file a police complaint for offences under the BNS.
Under the Code on Social Security, 2020, fixed-term employees are eligible for gratuity on a proportionate basis after one year of service, while regular employees need five years of continuous service, except in cases such as death or disablement. Gratuity claims go to the competent authority if the employer does not pay.
No. Describing your matter and booking a first consultation with an enrolled advocate is free. Any fee for further work is agreed directly between you and the advocate.
