Online fraud, hacking, impersonation and online harassment in Kolkata

Cyber complaints in Kolkata come from every age group. Retired people receive calls from fraudsters posing as bank staff or officials and are persuaded to share an OTP or install a screen-sharing app. Young professionals fall for fake job offers, part-time task scams and investment groups on messaging apps. Small businesses find their email accounts hacked and payments diverted to a fraudster's account. Others discover fake social media profiles using their photographs, or face online stalking, threats and the circulation of private images.

The main laws are the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita, 2023 (BNS). Under the IT Act, Section 66C covers identity theft, Section 66D covers cheating by personation using a computer resource, and Section 66E covers violation of privacy, while Sections 67 and 67A deal with publishing obscene and sexually explicit material. The BNS covers cheating (Section 318, old Section 420 IPC), cheating by personation, stalking, extortion and criminal intimidation. The Digital Personal Data Protection Act, 2023 adds a framework for how organisations handle personal data.

Speed is the single most important factor in financial fraud. If money has been taken, call the national cyber fraud helpline 1930 or report at cybercrime.gov.in immediately, because the system alerts banks and payment platforms to try to freeze the funds before they are withdrawn. Inform your bank in writing as well. For harassment and impersonation, collect screenshots with dates and links, report the content to the platform, and then file a complaint with the police. An advocate can help when the police are slow, the platform does not respond, or you are wrongly accused.

Main law: Information Technology Act, 2000; Bharatiya Nyaya Sanhita, 2023; Digital Personal Data Protection Act, 2023.

Where these matters are heard in Kolkata

In Kolkata, cyber offences are investigated by Kolkata Police, including its Cyber Police Station, and by the local police station where the victim lives or the offence was noticed. For Salt Lake and New Town, Bidhannagar Police handles complaints through its own police stations. The National Cyber Crime Reporting Portal routes online complaints to the appropriate unit. Once an FIR is registered and investigation completes, the case is tried before the Chief Metropolitan Magistrate Court at Bankshall Street or another Metropolitan Magistrate court, and serious matters go to the City Sessions Court.

For compensation claims where a person or company failed to protect data or caused loss through a computer contravention, the IT Act provides for an Adjudicating Officer, and appeals from that officer go to the appellate tribunal designated under the Act. Criminal appeals and quashing petitions go to the Calcutta High Court. Disputes over content removal can also be raised with the platform's grievance officer and then the Grievance Appellate Committee under the IT Rules; your advocate will confirm the right route.

How a cyber matter usually moves in Kolkata

  1. Report fraud within the first hours
Call 1930 or file on cybercrime.gov.in and note the acknowledgement number. Inform your bank and ask it to block the card, account or UPI ID used. The earlier this is done, the better the chance of the amount being frozen.
  2. Preserve the evidence
Take screenshots of messages, transaction IDs, phone numbers, profile links and email headers, and do not delete the chats. Keep the device itself safe, since it may need to be examined.
  3. File a complaint with the police
Submit a written complaint to the Cyber Police Station or the local police station with copies of the evidence. Ask for an FIR to be registered where a cognizable offence is disclosed, and keep a receipt. If the police only make a diary entry, ask in writing for the reason and keep a copy.
  4. Report to the platform
Use the reporting tools on the social media, messaging or shopping platform and write to its grievance officer. Platforms are required under the IT Rules to act on complaints within set timelines. Keep a record of every report and response, since this may be needed later in court.
  5. Follow up the investigation
The police may request data from banks, telecom companies and platforms to trace the accused. Your advocate can follow up, apply to the court for release of frozen money, and protect your interests at each stage.
  6. Trial or compensation claim
Once a chargesheet is filed, the case proceeds in the Magistrate Court. Separately, you may pursue a civil or IT Act compensation claim, or a consumer complaint against a bank that failed in its duty.

Documents to keep ready

  • 1930 or cybercrime.gov.in acknowledgement number
  • Bank statement showing the disputed transactions
  • Screenshots of chats, calls, emails and profiles
  • Links (URLs) of fake profiles or offending posts
  • Transaction IDs and UPI or wallet references
  • Letters or emails sent to the bank
  • Copy of the police complaint and FIR
  • Identity proof of the complainant

Mistakes to avoid

  • Waiting a day or two before calling 1930, which gives fraudsters time to move the money.
  • Paying a so-called recovery agent who promises to get the money back for a fee.
  • Deleting chats or blocking the fraudster's number before saving evidence.
  • Confronting the person harassing you online instead of reporting and documenting.
  • Sharing the OTP or installing an app suggested by a caller claiming to help with the complaint.

Kolkata: local points to know

Choosing and working with an advocate

Look for an advocate who handles cyber matters regularly and understands how the Cyber Police Station, Bidhannagar Police and the Magistrate Courts in Kolkata deal with frozen funds and data requests. Ask for the advocate's enrolment number and verify it with the Bar Council of West Bengal. Be wary of anyone who claims they can recover money quickly through personal contacts, since recovery depends on the legal process and the speed of reporting.

Agree the scope and fee in writing, for example whether it covers only the complaint and follow-up or also the application for release of money and the trial, and ask for receipts. Fees depend on the advocate and the matter. Mara Vakil charges clients nothing to find or consult advocates and only helps you find enrolled advocates and book a free consultation; it is not a law firm and does not give legal advice. In an emergency involving threats to safety, call 112, and women can also call 181.

On Mara Vakil you describe your matter once and enrolled advocates who handle cyber matters in Kolkata can accept it and call you. Mara Vakil charges clients nothing to find or consult advocates. Send your matter →

Questions people ask about cyber matters in Kolkata

I lost money in an online fraud in Kolkata. What should I do first?

Call 1930 or report at cybercrime.gov.in immediately and note the acknowledgement number. Then inform your bank in writing and file a complaint with the Cyber Police Station or your local police station. Speed decides whether the money can be frozen.

Can the money be recovered?

If the funds are frozen in the fraudster's or a mule account in time, the court can order their release to you after verification. Recovery is not certain and depends on how quickly the fraud was reported and how far the money has moved. Be careful of anyone who calls offering to recover the amount for a fee, as this is a common second scam.

Someone made a fake profile with my photos. Is this a crime?

Yes. Impersonation and identity theft can attract Sections 66C and 66D of the IT Act and provisions of the BNS. Report the profile to the platform, save the link and screenshots, and file a police complaint. If intimate images have been shared, the platform must act on a complaint from the person shown, and you can ask for removal quickly.

Where do I complain about online harassment in Kolkata?

You can file with the Kolkata Police Cyber Police Station, your local police station, or Bidhannagar Police if you live in Salt Lake or New Town. Online reporting on cybercrime.gov.in is also available, including a dedicated section for offences against women and children.

Is my bank responsible for unauthorised transactions?

Under RBI rules, a customer's liability can be zero or limited if an unauthorised electronic transaction is reported promptly and the customer was not negligent. If the bank does not respond properly, you can approach the RBI Ombudsman or the consumer commission. Keep copies of every letter to the bank and its reply.

I have been wrongly accused of a cyber offence. What should I do?

Do not delete data or ignore police notices. Consult an advocate before giving any statement, as you may need to seek anticipatory bail or explain the technical facts with records. In some cases a bank account is frozen only because it received money passed through other accounts, and that can be addressed before the court.
