Consumer complaints against products, services and builders in Hyderabad

Consumer complaints from Hyderabad residents often involve housing, insurance, banking, online shopping, hospitals, airlines and education services. A homebuyer in a gated project may be waiting for possession well beyond the promised date; a family may have had a health insurance claim repudiated on a technical ground; a customer may have bought an appliance that failed repeatedly within warranty. The common thread is that a business took money and did not deliver what it promised, or delivered it badly.

The Consumer Protection Act, 2019 allows a consumer to claim refund, replacement, repair, compensation and costs for a defective product, a deficiency in service or an unfair trade practice. The Commissions are meant to be quicker and less formal than civil courts, and a consumer can file and argue the complaint personally. Many people still prefer an advocate when the opposite party is a large company, when the facts are technical, or when the claim involves calculation of interest and compensation over several years.

The amount paid for the goods or services decides which Commission hears the complaint: the District Commission up to ₹50 lakh, the State Commission above ₹50 lakh and up to ₹2 crore, and the National Commission above ₹2 crore. A complaint should normally be filed within two years of the cause of action, and delay beyond that needs a separate application explaining it. Complaints can be filed online through e-Jagriti, which also allows documents and fees to be uploaded. Hearings can sometimes be attended through video conferencing, which helps working complainants who cannot take many days off.

Main law: Consumer Protection Act, 2019; complaints filed online through e-Jagriti.

Where these matters are heard in Hyderabad

Complaints arising in Hyderabad up to ₹50 lakh go to the Hyderabad District Consumer Disputes Redressal Commissions. Higher-value complaints, and appeals from the District Commissions, are heard by the Telangana State Consumer Disputes Redressal Commission, which also sits in Hyderabad. Above ₹2 crore, the complaint goes to the National Commission in New Delhi. A complaint can usually be filed where the opposite party carries on business, where the cause of action arose, or where the complainant lives or works.

An appeal from a District Commission order lies to the State Commission, and from the State Commission to the National Commission, within the time limits in the Act; an appeal by the party ordered to pay requires a deposit of part of the amount. For delayed housing projects, a homebuyer may also approach Telangana RERA (TS-RERA) under the Real Estate (Regulation and Development) Act, 2016. Choosing between RERA and the Consumer Commission is a strategic decision your advocate can help with. Orders of either forum can be enforced through their own execution procedures if the builder does not comply.

How a consumer matter usually moves in Hyderabad

  1. Write to the company first
Send a written complaint to the seller or service provider and keep the reply or ticket number. This shows you gave them a chance to fix the problem. Many companies also have a grievance officer or nodal officer whose details are on their website, and escalating to that officer creates a useful record.
  2. Send a legal notice
If nothing changes, a legal notice setting out the defect and the relief sought is sent. It is not compulsory, but it often prompts a settlement and frames the later complaint.
  3. Prepare the complaint
The complaint describes the purchase, the defect or deficiency, the loss suffered and the relief asked for. Copies of bills, warranty cards and correspondence are attached as annexures.
  4. File through e-Jagriti
The complaint is filed online or at the Commission, with the prescribed fee based on the claim. The Commission then decides whether to admit it and issues notice to the opposite party.
  5. Reply, evidence and mediation
The opposite party files a written version, and both sides submit evidence on affidavit. The Commission may refer the matter to mediation if both sides agree.
  6. Order and execution
After hearing arguments, the Commission passes an order. If the opposite party does not comply, the consumer can file for execution, and non-compliance can attract penalties under the Act.

Documents to keep ready

  • Invoice, bill or receipt of purchase
  • Warranty card or service contract
  • Insurance policy and claim rejection letter
  • Builder agreement and payment receipts
  • Emails, chats and complaint ticket numbers
  • Photographs or videos of the defect
  • Service or repair job sheets
  • Copy of the legal notice and delivery proof

Mistakes to avoid

  • Do not wait beyond two years from the cause of action without a strong reason for the delay.
  • Do not overstate the claim, because the value you claim decides the Commission and the fee.
  • Do not throw away the packaging, bill or warranty card of a defective product.
  • Do not sign a full and final settlement with the company without reading what rights you are giving up.
  • Do not file the same complaint in two forums without telling each of them.

Hyderabad: local points to know

Choosing and working with an advocate

If you decide to engage an advocate, look for someone who regularly appears before the Hyderabad District Commissions or the Telangana State Commission and understands the type of dispute you have, whether insurance, banking or housing. Confirm the enrolment number with the Bar Council of Telangana. A good first meeting should end with a clear view of the correct Commission, the relief to be claimed and the evidence still missing.

Agree the fee and scope of work in writing, including whether appeals and execution are covered. Fees depend on the advocate and the matter, and you should collect a receipt for every payment. Remember that you can file a consumer complaint yourself. Mara Vakil is free for clients and simply helps you book a free consultation with an enrolled advocate.

On Mara Vakil you describe your matter once and enrolled advocates who handle consumer matters in Hyderabad can accept it and call you. Mara Vakil charges clients nothing to find or consult advocates. Send your matter →

Questions people ask about consumer matters in Hyderabad

Can I file a consumer complaint in Hyderabad without an advocate?

Yes. The Act allows a consumer to file and argue the complaint personally, and e-Jagriti makes online filing possible. Many people take an advocate's help for drafting or for complaints against large companies. Whoever files must attend hearings or authorise someone, because repeated absence can lead to dismissal.

Which Commission will hear my complaint?

It depends on the value of goods or services paid for. Up to ₹50 lakh it goes to the District Commission, above ₹50 lakh up to ₹2 crore to the Telangana State Commission, and above ₹2 crore to the National Commission. The value is what was paid, not the amount of compensation claimed.

My builder has delayed possession. Should I go to RERA or the Consumer Commission?

Both can be possible for a homebuyer. TS-RERA deals specifically with registered projects under the RERA Act, while the Consumer Commission can award compensation for deficiency in service. An advocate can help you choose based on your agreement and goals.

What is the time limit for filing?

A complaint should normally be filed within two years from the date of the cause of action. If it is late, an application for condonation of delay must explain the reasons, and the Commission decides whether to accept it. In builder cases, the cause of action may continue until possession is offered, which your advocate will assess.

Can I claim compensation for mental harassment?

Commissions can award compensation for loss and injury suffered due to deficiency in service, which may include harassment and inconvenience. The amount depends on the facts and is decided by the Commission. Claims are stronger when the complaint explains clearly how the deficiency affected you, supported by documents.

How do I file on e-Jagriti?

You register on the portal, fill in details of the parties and the claim, upload the complaint and documents, and pay the fee online. The Commission then scrutinises the filing and lists it for admission. Keep the acknowledgement and the case number, as you will need them to follow listings and download orders.
